TERMS AND CONDITIONS

NOTE: TravelArte Experiences (referred to as “we”, “us” or “our”) is a destination management company (DMC), tour operator, event and travel organizer.
We design and coordinate travel experiences using a network of carefully selected independent suppliers, including accommodation providers, transport companies, guides and other service providers. While we take care in selecting our partners, these suppliers operate independently and are not under our direct control.
While we make every effort to ensure the accuracy of the information provided, TravelArteExperiences does not accept any liability for errors or omissions.
CONSENT TO TERMS AND CONDITIONS
Please read these Terms and Conditions carefully, as they apply to all bookings confirmed with TravelArte Experiences.
By confirming a booking with us, you agree to be bound by these Terms and Conditions. Booking any of the travel products and services we provide constitutes acceptance of these Terms.
We may update these Terms and Conditions from time to time. The version in force at the time of booking will apply.
BOOKING, PAYMENT AND CANCELLATION POLICY*:
1. Tailor-Made (Bespoke) and Extended Multi-Day Tours (Private or Shared)
To confirm your booking, a 30% deposit is required within 7 days of written confirmation.
The deposit is refundable for cancellations made up to 60 days prior to arrival, after which it becomes non-refundable.
The remaining balance (70%) must be paid no later than 45 days prior to arrival, after which the booking becomes non-refundable.
For cancellations made between 60 and 45 days prior to arrival, a cancellation fee of 50% of the total tour price applies.
Itinerary Development Policy
The first two (2) itinerary versions or revisions are provided complimentary. From the third requested revision onward, a planning and development fee applies. This fee:
• Covers additional research, supplier coordination and repricing;
• Is required prior to further revisions being issued;
• Will be deducted from the final tour balance should the booking be confirmed.
In the event that the tour is not confirmed, the planning fee is non-refundable.
2. Day Tours or City Tours
Full payment (100%) is required at the time of booking.
Cancellations can be made free of charge up to 24 hours before the scheduled start time.
Cancellations made within 24 hours of the start time, or no-shows, are non-refundable.
* Some tours may have specific cancellation terms. Please refer to your booking confirmation for details related to your selected experience.
Price Adjustments
TravelArte Experiences reserves the right to adjust the package price as a direct result of changes in:
• The cost of passenger transportation due to fuel or energy prices;
• Taxes or fees imposed by third parties;
• Exchange rates relevant to the package.
Any price adjustment will be communicated clearly and no later than 20 days prior to arrival.
If the increase exceeds 10% of the total package price, the Client may cancel the booking without penalty and will receive a full refund.
The Client is also entitled to a price reduction corresponding to any decrease in the above costs.
No Refunds for Unused Arrangements: As our prices are based on contract rates, no refunds will be provided for unused portions of a travel booking. If you cancel while the tour is in progress, there is no refund for the unused portion.
Minimum Participants: Certain experiences require a minimum number of participants. If this number is not reached, we reserve the right to cancel the experience. In such cases, you will be offered an alternative where possible, or a full refund of amounts paid.
TRAVEL INSURANCE
Travel insurance is NOT included in the tour price. We strongly recommend that you arrange your own travel insurance to cover against illness, injury, loss/damage to personal belongings.
SIGNIFICANT CHANGES BEFORE DEPARTURE
If we are required to make a significant change to the main elements of your booking before departure, we will inform you as soon as reasonably possible. You may then accept the change or cancel the booking and receive a full refund of amounts paid to us.
TRANSFER OF BOOKING
The Client may transfer the booking to another person, subject to our prior approval, applicable conditions and any additional costs incurred.
CURRENCY
All rates are quoted in EURO, although you can pay in USD, GBP or RON. The parity that we consider is the one provided by The National Romanian Bank (BNR) from the last business day before the date that appears on your invoice; the exchange rate and date will be clearly stated on the final invoice.
When you want to pay in different currencies, please specify this in your communication with us.
TRAVEL DOCUMENTS
We are happy to assist with general guidance regarding travel documentation, including immigration, customs and health requirements. However, it remains your responsibility to obtain and carry all necessary travel documents required by the relevant authorities, including passports, visas and any other applicable documentation. Failure to present the required documents may result in denied boarding or entry, and may lead to the cancellation of your booking without refund.
COMPLAINTS
If you experience any issue during your trip, please inform us or your guide as soon as possible so we can address it promptly. Any complaints must be submitted in writing within 20 days after the completion of the tour. Delayed notification may affect our ability to investigate and resolve the matter.
LUGGAGE
Luggage capacity may vary depending on the vehicle and the nature of the experience. Please inform us in advance if you intend to travel with oversized or additional baggage.
RIGHT TO REFUSE SERVICE
We reserve the right to refuse participation or remove any individual whose behavior is disruptive, unsafe or negatively affects the experience of others. In such cases, no refund will be provided.
LIMITATION OF RESPONSIBILITY AND DISCLOSURE
TravelArte Experiences acts as an organizer and coordinator of travel services provided by independent third-party suppliers, including accommodation providers, transport companies, guides and other service providers.While we carefully select our partners, these suppliers operate independently and are not under our direct control.
TravelArte Experiences shall not be liable for any personal injury, loss, damage, delay or inconvenience arising from the acts or omissions of these third-party suppliers, or from circumstances beyond our reasonable control.
We are also not responsible for disruptions caused by weather conditions, transport delays, or other external factors that may affect the travel experience.
FORCE MAJEURE
“Force Majeure” means, in relation to TravelArte Experiences, any circumstances beyond the reasonable control of TravelArte Experiences, including, but without limitation: acts of God, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions, technical issues affecting transport or operations, delay, wildlife or other untoward occurrences.
We will not be liable, by reason of delay in performance, or by non-performance, of any of our obligations hereunder to the extent that they occur due to any Force Majeure.
If TravelArte Experiences, and/or any of its travel suppliers, are affected by Force Majeure, they can vary or cancel any itinerary or arrangement in relation to the trip. Any potential refunds will depend on the recoverable costs from our suppliers, although we will make reasonable efforts to reimburse you where possible. However, we shall be entitled to deduct from any refund recoverable the actual and potential costs incurred up to that moment.
CANCELLATION RIGHTS
We reserve the right to cancel or modify a booking in exceptional operational circumstances. If we cancel a booking for reasons other than Force Majeure, you will receive a full refund of all amounts paid to us.
NO COPYING OR EDITING
All content made available by TravelArte Experiences, including text, images and materials, may not be reproduced, distributed or used without prior written consent. Unauthorized use of any such material is prohibited.
PRIVACY POLICY
Because we value our guests, we believe that strong electronic privacy is crucial. We will not release your personal data to anyone else, except if you provide your consent or if it is disclosed for the purposes for which you made it available to us.
The only contact details gathered are those the Client voluntarily submits – through enquiry forms, survey forms, telephone, email, website or other communication channels. Comments and client contact details are published on the site’s feedback page only with the Client’s written consent. Any requests to unsubscribe from mailing lists or remove personal data from our databases should be submitted by email. Email newsletter subscribers are able to unsubscribe themselves from mailing lists by clicking on the link at the foot of all email newsletters.
WHO WE SHARE YOUR INFORMATION WITH
We do not disclose any information about Client bookings to anyone except in the following circumstances:
• Accommodation suppliers
• Legal obligations: We may be required by law to disclose information against someone whose activities could cause harm to others or in cases of Client fraud.
FINAL PROVISIONS
These Terms and Conditions constitute the entire Agreement between the Client and TravelArte Experiences and are governed by the laws of Romania.
The sale of travel packages will be made in accordance with the hereby agreement and in compliance with the provisions of Government Ordinance no. 107/1999 on the marketing of travel packages, approved with amendments and completions by Law no. 631/2001, Order no. 516/2005 of 12/04/2005 published in the Official Gazette, Part I no. 334 of 20/04/2005 with subsequent amendments. For any possible debates or questions not covered by this contract, the laws of Romania shall have effect.
